保险费的交付义务可否由第三人代为履行是一个颇值得探讨的问题。笔者分别从财产保险合同与人身保险合同两方面对这一问题进行了论述。在财产保险合同中,保险费的交付在性质上与一般债务相同,所以由任意第三人代付保险费也应为事理所允许;在人身保险合同中,因其以保障被保险人的生命、安全为主要目的,为防止主观危险,应该认为其保险费的交付是具有特殊性质的债务,不得由任意第三人代付。
