心理学视角的财产与所有权分析

对财产权利进行法律构建及政治、伦理或者经济基础上的历史论证,往往是产权律师和理论学者所着力关注的,但他们很少探究财产权利潜在的心理基础及其所带来的深远影响。同样地,为解释人类行为及人类社会的交互作用,心理学家,无论是侧重个体心理学还是社会心理学,虽提供了诸多研究范式,但对财产权利鲜有涉及,即便有也只是偶然简短的评论。早在75年前,就曾已出现一项关于财产社会心理的初步研究。本文深入个体心理学和社会心理学的近代研究,评断某些研究结果是否能够用于解释财产权利存在的心理基础及产权的重要性。这也许还开启了这个领域最新的交叉学科研究。 The legal construction of property rights and the historical argumentation on the political, ethical or economic basis are often focused on by property lawyers and theorists. However, they seldom explore the potential psychological basis of property rights and their far-reaching impact. Similarly, in order to explain the interaction between human behavior and human society, psychologists, whether focusing on individual psychology or social psychology, have provided many research paradigms but rarely involve property rights, if only by chance comment of. As early as 75 years ago, there had been a preliminary study on the psychology of property. This article goes deep into the modern studies of individual psychology and social psychology and judges whether some of the research results can be used to explain the psychological foundation of property rights and the importance of property rights. This may also open up the latest interdisciplinary research in this area.
