上中学那会儿,就知道美国联邦最高法院只有九个大法官。就九个人能干些什么?干得过来吗? 怎么两百年了也没机构臃肿?当时很是疑惑,也很是好奇。后来上了大学,虽然了解得多了一些,可对三权之一的司法权,却跟许多人一样,脑子里并没有多少具体概念。可以说,美国法学家麦克洛斯基的《美国最高法院》虽然不见得对每个人都能解惑,但起码也是本增进知识的好参考。事实上,这是一本充满思想魅力的经典之作,文风简洁平易,娓娓道来, 甚至语言优美得会让有些中国学者认为治学不规范。因为在《美国最高法院》里有这样的句子:“在这些年里,正当大法官们一步步地追随着中庸之路时,他们的身旁却一直站着一个幽灵……”按照麦克洛斯基的说法,美国联邦最高法院已经是人类历史上最有权力的法院,获得了世界历史上任何一个司法
