日本政府强行通过新安保法案解禁集体自卫权的行为,虽然属于国内法调整范围,但是根据日本关于国际法与国内法关系的实践,政治性条约、与国家安危高度相关的条约具有高于国内法的效力,所以其立法等行为同样应该受到相关国际法规定约束。日本解禁集体自卫权违反了第二次世界大战后与战胜国所签订的《开罗宣言》《波茨坦公告》以及《联合国家宣言》中对其主权的限制,冲击了战后秩序,故须对其违反国际法的行为承担继续履行、恢复原状、道歉的国际责任。
