台湾地区在实现案件繁简分流、优化司法资源配置的道路上探索了刑事协商程序。这一程序结合了两大法系的立法经验,吸收了协商性的司法理念,允许被告人与检察机关进行平等的量刑协商和部分负担协商。虽然由于审前分流程序的交叉和司法细节的考虑不足,在实际运行中还存在一些缺陷,但是通过与内地当前制度的对比中所呈现出的一些特点可看出,该程序所体现出的协商性的司法理念和审前程序的分流处理值得思考和借鉴。
Taiwan has explored the criminal negotiation process on the road of simplifying and simplifying cases and optimizing the allocation of judicial resources.
