英国普通法令状体系构成了美国行政法体系的开端,法治原则作为美国行政法上基本原则之一,却较少被学界和著作深入的谈及。这与错误的法治传统观念的影响是密切联系的。而行政法治理念的价值追求,正在于为了适应利益需要而不断追寻新的精神支撑。
The common law system in Britain constituted the beginning of the system of administrative law in the United States. As one of the basic principles of the administrative law in the United States, the principle of the rule of law is seldom talked about in depth by the academic circles and writings. This is closely linked with the influence of the erroneous traditional concept of rule of law. The pursuit of the value of the idea of administrative law is in pursuit of new spiritual support in order to meet the needs of interests.
