我国相关行政法律中,对违反行政程序的法律后果规定的较为简单,而这个问题并不简单,正如杨海坤学者所说,“‘程序违法也属违法’以及违反法定程序应承担法律责任,从理论上来讲似乎无须争辩……由于程序规定与实体规定相比,有它的抽象性等与实体规定之间存在的客观差异……使得实践中程序违法之后果,并不像实体违法责任那样简单。”本文以期从介绍两个国家对行政程序违法的有关规定来对我国的行政程序中法律责任规定的完善有所借鉴。
