随着国家对公民权利保护的重视,消费者法律保护问题的研究也逐渐升温。一些行政执法部门和学者从全面依法治国的战略高度,积极探索现代化条件下消费者法律保护问题的解决之道。他们从社会、经济、生活等多个方面对消费者主体的界定、生活消费的范畴、消费者保护的内涵等做了许多高水平的论述和有益的研究。笔者生活在基层,针对现代社会中出现的消费问题也作了一些整理和浅显的思考,我认为理清消费领域发生的新问题,对我国消费者权益的立法指导和司法实践有一定的现实意义。 With the state’s emphasis on the protection of civil rights, the research on the legal protection of consumers is also gradually heating up. Some administrative law enforcement departments and scholars have actively explored ways to solve the problem of consumer legal protection under the conditions of modernization from the strategic perspective of administering the country according to law in an all-round way. They have made many high-level expositions and useful studies on the definition of the main body of consumers, the category of living consumption and the connotation of consumer protection from the aspects of society, economy and life. The author lives in the grassroots level and made some collation and superficial thinking on the consumption problems appearing in the modern society. I think it is of some practical significance to sort out the new problems in the field of consumption to the legislative guidance and judicial practice of our country’s consumer rights and interests .
