当下,我国在建设有为政府与绿色生态理念的指导下,环境信息公开已经成为政府工作的重要内容,也是社会公众参与环境保护工作的重要途径。环境信息公开的状况直接关系到社会公众环境知情权的实现,同时也是我国生态文明制度建设的重要组成部分。司法审查作为维护公民环境知情权的最后屏障,其理论与现实作用不容轻视。然而,司法审查的指导思想,诉讼的受案范围及裁判方式等的不足,使得我国的环境信息公开司法审查现状并不尽如人意,当前法院对政府公开的环境信息很难进行有效的司法审查,这与我国法治政府和维护公众环境参与权的要求不相符。所以,进行环境信息公开司法审查制度的研究,就是为了更好地贯彻和落实生态文明制度建设要求及新《环境保护法》的相关规定。
At present, under the guidance of building a government and a green ecological concept, the disclosure of environmental information has become an important part of government work and an important way for the public to participate in environmental protection. The status of disclosure of environmental information is directly related to the realization of the public’s right to know the environment of the public and an important part of the construction of ecological civilization system in our country. Judicial review, as the last barrier to safeguard the citizen’s right to know the environment, can not be ignored in theory and in reality. However, the guiding ideology of judicial review, the scope of litigation and the ways of adjudication are not satisfactory, and the current court is not able to conduct an effective judicial review of the environmental information disclosed by the government , Which is inconsistent with the requirement of our rule of law government and safeguarding the right of public participation in the environment. Therefore, the research on the system of judicial review of environmental information disclosure is to better implement the requirements of the construction of ecological civilization system and the relevant provisions of the new “Environmental Protection Law.”
