宪法作为我国的根本大法,将其运用到司法程序中,作为审理具体案件的直接依据是法治发展的必然。但我国法律对宪法司法化问题尚无明确的规范。宪法司法化存在着一些障碍,这不利于我国法治建设的发展。因此,实现宪法司法化,维护宪法权威,更大限度地保护公民的基本权利已成为当前法治建设的一项紧迫任务。 As the fundamental law of our country, the constitution is applied to the judicial procedure as the direct basis for the hearing of the specific case, which is the inevitable development of the rule of law. However, there is no clear standard for the judicialization of the constitution in our country’s law. There are some obstacles to the judicialization of the constitution, which is not conducive to the development of the rule of law in our country. Therefore, to realize constitutional justice, safeguard constitutional authority and protect citizens’ basic rights to a greater extent has become an urgent task for the current construction of law.
