支持起诉制度在《民事诉讼法》总则中只有一条原则性的规定,由于缺乏具体操作措施,因而被称之为原则性的制度。检察机关支持起诉作为支持起诉制度中的一个子制度虽然也面临着这种局面,但是司法实践中广大民行检察官却在充分地发挥自身智慧办理了大量支持起诉案件,当然这其中遇到的问题是比较多的。本文仅就实践中民行检察人员比较关心的管辖权问题进行探讨,以达到丰富司法实践之目的。 There is only one principle in supporting the prosecution system in the general provisions of the Code of Civil Procedure, which is called a principled system because of the lack of concrete operational measures.
