经历了将近三十年的发展,国际法中已经发展出了一套调整地雷的专门条约体系以及相对明确的习惯法规则。它们对于减轻地雷引起的人道灾难作出了重大贡献。然而,地雷问题仍然是困扰当今国际社会的一个严重的人道问题。除了非法律的原因外,这和关于地雷的国际法,尤其是和《经修正后〈常规武器公约〉第二议定书》及《渥太华公约》本身存在的缺陷密不可分。国际社会仍然应当关注地雷问题,努力解决存在的法律问题。
After nearly 30 years of development, international law has developed a set of specialized treaty regimes for mine adjustment and relatively well-defined rules of customary law. They have made a significant contribution to mitigating the humanitarian disaster caused by landmines. However, the issue of landmines remains a serious humanitarian issue that plagues the international community today. Except for non-legal reasons, this is inextricably linked with the international law regarding landmines, in particular with the deficiencies inherent in the Second Protocol to the Convention on Conventional Weapons and the Ottawa Convention. The international community should still pay attention to the issue of landmines and work hard to solve the existing legal problems.
