在国际贸易中,产品生产成本中如果未将环保成本计算进去,其价格肯定比包含了环保成本的产品价格低,而只要存在环保成本的差异,就有可能构成生态倾销。为了应对生态倾销的影响,发达国家提出了反生态倾销主义的思想,即只要是对环境有负面影响的进口产品都必须被限制,甚至会对相关产品实施一定程度的经济制裁。这种做法虽是许多国家的通常做法,但至今没有被国际贸易组织合法化。因此,只能将国际贸易中的反生态倾销定义为潜规则,本文在对生态经济进行界定的同时,主要分析生态倾销的主要特点,并探讨解决此类问题的主要措施。
In international trade, if the cost of production is not included in the cost of the environment, the price must be lower than that of the product that contains the cost of environmental protection. However, as long as there are differences in the cost of environmental protection, it may constitute ecological dumping. In order to cope with the impact of ecological dumping, the developed countries put forward the idea of anti-ecological dumping that any imported products that have a negative impact on the environment must be limited and even some degree of economic sanctions should be imposed on the related products. This practice, though common practice in many countries, has so far not been legalized by the International Trade Organization. Therefore, the anti-ecological dumping in international trade can only be defined as the unspoken rules. While defining the ecological economy, this paper mainly analyzes the main features of eco-dumping and discusses the main measures to solve such problems.
