法律的强制力体现于法律的产生与运行的各个步骤:通过制定法律,其效力得以产生;通过司法,其强制力得以执行。由此,国际劳工标准的强制力表现于:制定和效力的产生,以何种方式实现雇主、雇员和政府的三方对话,以及如何实现这些规则在司法中的强制适用。因此,本文讨论国际劳工标准的制定(公约和议定书)、国际劳工标准纳入成员实施计划以及控制三个主要问题,并阐明其对中国的影响。
The force of law is manifested in every step of the law's production and operation: its effectiveness can be produced through the formulation of laws; its enforcement can be enforced through the judiciary. As a result, the force of international labor standards is manifested in the creation and effectiveness of production, the ways in which the three parties' dialogues between employers, employees and the government are realized and how the rules are enforced in the administration of justice. Therefore, this article discusses the development of international labor standards (conventions and protocols), the inclusion of international labor standards in member implementation plans, and the control of three major issues, as well as clarifying its impact on China.
