本文通过一则案例探讨了运用细分和叠加两种分析方法处理刑事案件的先后程序,即先细分为数个行为,对照刑法分别贴上相应的罪名标签,再运用叠加方法,详观刑法分则各罪名,甄别出应当叠加评价的整体犯罪行为,最终确定刑法总分则相结合意义上的行为数和罪数,准确地实施单罪处罚或数罪并罚。 This article through a case study of the use of subdivision and superposition of two analytical methods to deal with criminal cases before and after the procedure, which first subdivided into several acts, respectively, according to the criminal law labeled corresponding charges, and then use the superposition method, detailing the criminal law points The offenses shall be screened out as a whole criminal act which should be supervised and evaluated.
