本文认为《物权法》对占有的保护规定过于简单、笼统,并通过案例有针对性地说明了这个问题。《物权法》对占有的各种性质、状态、类型等没有区分,是对占有的过于简单规定;《物权法》对占有的保护实行了“只要存在占有事实”就进行保护的规定,是对占有保护的泛化。这样最终不能真正明确物的归属,发挥物的效用,保护权利人的权利。
This article argues that the “Property Law” is too simple and general to the protection of possession, and illustrates the problem through the case. The Property Law does not distinguish between the various properties, states and types of possession, and it is an overly simple stipulation of possession. The Real Right Law provides for the protection of possession by providing “as long as possession facts exist” The generalization of protection. In the end, we can not really clarify the attribution of things, display the usefulness of things and protect the rights of right holders.
