婚姻登记制度是我国社会主义婚姻制度的重要组成部分,他包括结婚登记、离婚登记、复婚登记三个方面的内容。根据现行的《婚姻登记办法》的规定,办理婚姻登记的机关在城市是街道办事处或区人民政府、不设区的市人民政府,在农村是乡、民族乡、镇人民政府。具体由各级民政部门或民政助理办理。笔者认为:现行婚姻登记机关的设置是不妥当的,应改由司法行政机关公证处办理,理由是: Marriage registration system is an important part of China’s socialist marriages system.
