笔者针对非侵权剽窃行为展开课题研究期间,适值《高等学校预防与处理学术不端行为办法》颁布施行。通过研究,笔者认为应分设侵权剽窃与非侵权剽窃概念,改变长期以来对剽窃不做定性区分混为一谈的局面。进而借鉴波斯纳对剽窃的定义,指明非侵权剽窃行为中,作用于作品受众的欺诈剽窃应属于被追究的行为,可以且必须经由作品受众的证言证据证实欺诈剽窃成立。同时,应充分利用论文检测软件的补强作用,努力提升防治剽窃成效。
