事故报告制度在我国安全生产法律体系中占据重要地位,目前行政法学界还没有对这一问题展开研究,不无遗憾。事故报告制度确立的立法目的与我国立法的根本目的之间的冲突,决定了它在实际运行中要受制于各种制度环境。为此,有必要从理清其责任主体入手,分析影响其运行的客观因素。由于在现有条件下,某些因素一时难以克服,所以在进行制度设计时必须从实际出发。本文在借鉴了与安全生产领域相关的有益经验后,针对事故隐瞒的问题在报告机制、工作机制、参与机制、责任追究机制等方面提出了完善的建议。
Accident reporting system occupies an important place in the legal system of production safety in our country. At present, the administrative law circle has not studied this issue, and it is not without regret. The conflict between the legislative purpose of the accident reporting system and the fundamental purpose of our country’s legislation determines that it should be subject to various institutional environments in actual operation. Therefore, it is necessary to start with clarifying its responsibility subject and analyze the objective factors that affect its operation. As some factors are hard to overcome under the existing conditions, we must proceed from reality when designing the system. After drawing on the useful experience related to safety production, this paper puts forward perfect suggestions on the reporting mechanism, working mechanism, participation mechanism, accountability mechanism and so on.
