裁判员制度是日本国民参与审判的形式,是日本实现司法民主和完善法治的重要举措,也是战后60年来日本最大规模的司法改革动作。对实行临近两年的裁判员制度进行回顾和检视,可以发现裁判员制度的确是行走在既定的轨道上,初步实现了预定目标,但是未来仍将面临实践的挑战和考验。归根结底,是人的问题,国民的理解和参与是裁判员制度的最终保障。
The referee system is a form in which Japanese nationals participate in the trial. It is an important measure for Japan to realize judicial democracy and improve the rule of law. It is also Japan’s largest judicial reform movement in the 60 years since the war. Looking back and reviewing the referee system that has been implemented for nearly two years, we can see that the referee system is really walking on the established track and has basically achieved its intended goal. However, it will still face practical challenges and tests in the future. After all, it is a matter of man, and the understanding and participation of the people are the ultimate guarantee of the referee system.
