本文基于《公民权利和政治权利国际公约》的国际原则,从尊重人和保障人权的原则出发,鉴于我国目前精神损害赔偿制度不完善的现状,提出了拓宽精神损害赔偿范围的观点。文中认为就现行法律规定而言,对精神性人身权利的保护力度是不够的,权益救济范围和途径与人权保护原则不相适应,应当建立在刑事附带民事诉讼、国家赔偿、自然人社会权受侵害中的精神损害赔偿制度,以完善我国的人权保护制度。 Based on the international principle of “International Covenant on Civil and Political Rights” and based on the principle of respecting human beings and safeguarding human rights, this paper puts forward the view of broadening the scope of compensation for mental damages in view of the current imperfect system of compensation for mental damages in our country. The article thinks that as far as the current laws and regulations are concerned, the protection of spiritual personal rights is not enough. The scope and approach of the right relief are incompatible with the principle of human rights protection. It should be established in criminal incidental civil action, state compensation, social rights of natural persons In the spiritual damage compensation system to improve our country’s human rights protection system.
