在从广义和狭义两个层面梳理公共管制的原因与理论的基础上,本文认为现有的公共管制侧重于经济性规制,主要依托经济学理论和传统政治学理论,偏向采用利益分析法,而对于社会性规制并没有一致性理论依托。本文在将公共管制划分为利益管制和风险管制的基础上,提出增加风险分析法,并以风险社会理论和新政治学作为理论依据。风险分析和利益分析作为对立统一的两个分析法,应在管制决策中广泛应用。
On the basis of combing the reasons and theories of public regulation both broadly and narrowly, this paper argues that the existing public regulation focuses on economic regulation and mainly relies on the theory of economics and traditional political science to favor the use of interest analysis. There is no consistent theoretical support for social regulation. Based on the division of public control into interest control and risk control, this paper proposes to increase the risk analysis method, and takes the theory of risk society and the new political science as the theoretical basis. Risk Analysis and Benefit Analysis As the two analytic methods of unity of opposites, they should be widely used in regulatory decision-making.
