近几年来美国版权产业认为DMCA的实施无法达到制止严重的网上侵权之效果,因而呼吁和推动新的网络版权保护立法。由于SOPA/PIPA这两个新的立法动议力图增加互联网产业在版权执法中的义务,而且与言论自由、隐私权等复杂问题纠结在一起,难以形成共识而只能暂时搁置。目前,通过司法判例明确DMCA“避风港”更详细的适用规则以灵活调节各方利益仍是美国网络版权保护的首选之策。
In recent years, the U.S. copyright industry considers that the implementation of the DMCA can not achieve the effect of stopping the serious online infringement and therefore calls for and promotes the new legislation on online copyright protection. As the two new legislative initiatives, SOPA / PIPA, seek to increase the obligations of the Internet industry in the enforcement of copyright and are entangled with complicated issues such as freedom of expression and privacy, it is difficult to reach consensus and can only be put on hold. At present, it is still the first choice for cybersquat protection in the United States that the DMCA “Safe Harbor ” should be defined by judicial precedents so as to flexibly regulate the interests of all parties.
