我国现行《劳动合同法》明确规定除服务期和竞业限制条款外用人单位不得与劳动者约定由劳动者承担违约金。但是现实社会中劳动者迫于生计,不得已签订附有违约金条款的劳动合同。因此,我们需要通过重新定位《劳动合同法》中违约金的性质与功能,实施劳动仲裁调解、工会调解和法律援助,建立不法经营诚信档案记录等措施,掌握好维权劳动者权益的手段,以期妥善解决劳动争议、保证劳资关系的稳定。
China’s current “Labor Contract Law” clearly provides that in addition to the service period and non-competition restrictions, the employer shall not agree with the worker by the worker to bear the liquidated damages. However, in the real world, workers are forced to sign a contract of employment with liquidated damages. Therefore, we need to master the rights and interests of laborers by means of repositioning the nature and function of liquidated damages in the Labor Contract Law, implementing mediation of labor arbitration, mediation of trade unions and legal aid, and establishing record of illegal business records of integrity. Properly resolve labor disputes and ensure the stability of the labor-capital relations.
