儒家思想与新加坡鞭刑制度有着外在的对立和内在的契合。鞭刑在新加坡的产生、扩张与儒家思想无关,后者成为“立国之纲”后却开始密切地影响前者。儒家价值观和道德观为鞭刑提供新的思想依据,儒家思想与功利主义相结合为鞭刑制度奠定思想基础,并更进一步为国人所共鸣和接受。儒家思想使鞭刑功能更倾向于预防主义,而鞭刑亦成为重刑主义背景下协调罪责刑相适应的关键因素,儒家反酷刑本能以及清廉法治环境保障了鞭刑的威严和声誉。
Confucianism and Singapore whipping system has an external opposition and internal fit. Whipping whiplash in Singapore, expansion and Confucianism has nothing to do, the latter became “the founding principle” after it began to closely influence the former. Confucian values and moral values provide a new ideological basis for whipping. The combination of Confucianism and utilitarianism laid the ideological foundation for the whipping system and further resonated and accepted by the Chinese people. Confucianism makes whipping more inclined to preventiveism, whipping punishment has also become a key factor in coping with crime and punishment in the context of heavy penalties, Confucian anti-torture instincts and a clean and legal environment to protect the dignity and reputation of whipping.
