目前,公安机关在社会治安管理工作中,采取的主要手段之一就是实施限制人身自由的强制措施。这些措施中,除了被废止的收容遣送、收容审查制度外,还包括劳动教养、收容教养、收容安置抚养、行政拘留以及逮捕、拘传、拘留等刑事强制措施。在此,笔者仅对争议较多的劳动教养、收容教养、收容安置抚养等制度加以评析,试图揭示其中不适合法治新要求、不够完善之处,并提出修改建议。劳动教养制度的评析和修改建议劳动教养制度建立于1956年。有关劳动教养的法律依据主要包括:全国人大常委会批准《国务院关于劳动教养问题的决定》的决议(1957年)和《国务院关于劳动教养问题的补充决定》的决议(1979年)以及公安部《劳动教养试行办法》(1982年)。劳动教养是对被劳动教养的人实行强制性教育改造的一种
