随着网络技术的迅捷发展与全面适用,印度尼西亚开始在其法律体系中构建网络法律制度。2008年实施并于2016年11月修订的《信息与电子交易法》对网络犯罪、政府角色以及隐私与数据保护等做了规定,奠定了印尼网络法律制度的基础。印尼网络法律制度在理论上遵循法律构建二分法,在内容上以借鉴西方法律元素与融入本土宗教文化并重,在实践管理中呈现政府网络管理多头化等特点。当前,印度尼西亚网络法律制度还应当在内容丰富、体系规划以及立法分层等方面进一步加强与完善。
With the rapid development and full application of network technology, Indonesia began to establish a network legal system in its legal system. The Information and Electronic Transactions Act, which was implemented in 2008 and revised in November 2016, provides for cybercrime, government role and privacy and data protection, laying the foundation for the Indonesian network legal system. Indonesia’s network legal system follows the law in building dichotomy according to the law. In terms of content, it draws lessons from Western legal elements and incorporates local religious culture, and presents the characteristics of government network management in practice and management. At present, Indonesia’s Internet legal system should be further strengthened and improved in content enrichment, system planning and legislative stratification.
