为了保护我国珍贵、濒危的野生动物资源,有力地打击犯罪,运用实证研究方法对1995—2014年237件破坏珍贵、濒危野生动物资源案件进行统计与分析。结果表明,破坏珍贵、濒危野生动物资源的犯罪主要发生在经济水平发展较低但是动物比较丰富的西南部地区;当事人的文化水平普遍较低,对珍贵、濒危野生动物资源保护意识较弱;犯罪目的在于猎杀或者贩卖、运输珍贵、濒危野生动物资源以获得经济利益;量刑过程中,罚金自由裁量度大,刑罚较轻,缓刑适用情况居多。提出了相应建议和今后的研究方向。
In order to protect the precious and endangered wild animal resources in our country and effectively crack down on crimes, this paper uses the empirical research methods to conduct statistics and analysis on 237 cases of the destruction of rare and endangered wild animal resources from 1995 to 2014. The results showed that the crime of destroying the precious and endangered wildlife resources occurred mainly in the southwestern regions where the economic development level was relatively low but the animals were abundant. The cultural level of the parties was generally low, and the awareness of the protection of rare and endangered wildlife resources was weak. The purpose is to kill or sell, transport precious and endangered wildlife resources to gain economic benefits; during the sentencing process, the fine of penalty is large, the punishment is light, and the application of suspended sentence is mostly. Put forward the corresponding suggestions and future research directions.
