2011年6月30日,第十一届全国人民代表大会常务委员会第二十一次会议通过了《中华人民共和国行政强制法》(以下简称《行政强制法》)。该法与我国现行有效的其他法律法规和规章有一定的关联,对各类行政执法带来深远的影响,农业行政执法中涉及的行政强制项目也有10余种。该法实施后,笔者在执法实践中通过认真学习、仔细梳理、正确理解、准确把握、规范运用,探索积累了一些经验和做法。现就《行政强制法》对农业行政执法的影响和应对策略,谈一些粗浅的看法。
On June 30, 2011, the 21st Administrative Committee of the Eleventh National People’s Congress passed the Administrative Enforcement Law of the People’s Republic of China (hereinafter referred to as “Administrative Enforcement Law”). This law has certain connection with other laws, regulations and rules in force in our country and exerts far-reaching influence on all kinds of administrative law enforcement. There are more than 10 kinds of administrative compulsory items involved in agricultural administrative law enforcement. After the implementation of the law, the author in law enforcement practice through careful study, carefully combing, correctly understand, accurately grasp, regulate the use of exploration and accumulated some experience and practices. Now on the “Administrative Coercion Law” on the impact of agricultural administrative law enforcement and coping strategies, to talk about some superficial views.
