在构建不动产程序时,必须关注过程价值。就中国的实际情况而言,不动产程序的过程价值应当包括程序同一、程序参与和程序理性。程序同一指向法律制度的同一性,其旨在否定现行不动产登记制度的多元化状态。程序参与则要求制度给当事人设立更大的参与空间,以平衡私人和国家之间的利益关系。程序理性以论证为核心,强调不动产程序的职业化、说理性和确定性。过程价值并不与程序本位主义等同,过程价值应当与工具价值相互协调。
When building real-estate programs, one must focus on process value. In the case of China, the process value of immovable property procedures should include the same procedure, procedural participation and procedural rationality. The same procedure points to the sameness of the legal system, which aims to negate the diversified status of the current real estate registration system. Procedural participation requires the system to establish a greater space for participation of parties in order to balance the private and state interests. Procedural rationality takes argumentation as the core, emphasizing the professionalization, realism and certainty of real estate procedures. The process value is not the same as programmatic doctrine, and the process value should be coordinated with the tool value.
