GATS的目的旨在推进国际服务贸易自由化,但由于服务贸易的特殊性,使得推进服务贸易自由化的方式和进程不同于推进货物贸易自由化的方式和进程。因此,GATS在对各成员做出义务要求的同时还赋予各成员以适当的自主权,从而逐步实现服务贸易自由化。GATS第16条要求各成员对服务业的市场准入做出具体承诺;而GATS第6条则赋予各成员一定纪律要求下的国内监管权。但在实践中,关于GATS第6条国内监管与GATS第16条市场准入之间的关系一直是自GATS存在以来的敏感话题。
The purpose of GATS is to promote the liberalization of international trade in services. However, due to the particularity of trade in services, the ways and processes of liberalization of trade in services are different from those of the liberalization of trade in goods. Therefore, GATS, while making obligations to all its members, also gives all members appropriate autonomy in order to gradually liberalize trade in services. Article 16 of the GATS requires members to make a specific commitment to market access in the service sector, while Article 6 of the GATS gives domestic members the right to regulate under certain disciplinary requirements. In practice, however, the relationship between domestic regulation of Article 6 of the GATS and market access to Article 16 of the GATS has been a sensitive topic since the existence of the GATS.
