随着食品安全事故和食品国际贸易不断增多,食品安全问题因此成为人们关注的焦点。惩罚性赔偿制度应社会与现实之需被加入到食品安全法之中,其具有的惩罚功能、阻遏功能、补偿功能以及实现社会共治四大主要功能,以惩戒违法行为的方式来保障消费者的合法权益,从而解决关于人的身体健康和生命安全的重大社会问题。惩罚性赔偿制度的本身合理性问题以及食品安全标准体系完善是食品安全问题得到有效解决的关键。我国应当从健全法律体系、限制赔偿金数额、明确赔偿竞合问题、改善维护利益方式四个方面对我国的食品安全惩罚性赔偿制度进行完善从而保障消费者的权益,丰富我国的法律理论,并改善民事损害赔偿制度。
