我国正处于社会转型期,因之各种社会矛盾凸显,随之而来的是刑事案件数量激增,严重暴力犯罪多发,犯罪的种类和手段均出现了新的变化,这些都对我国社会管理提出了严峻挑战。我国法院不仅是社会矛盾的最后关口,还担负着维护社会稳定的职责,而司法资源具有有限性,为实现刑事案件的繁简分流,优化配置司法资源,以保障人权为主线,以实现正义与效率的法益最大化侵益最小化为目的,结合相关研究成果与多年的司法实践经验,新刑事诉讼法扩大了简易程序的适用范围,重构了适用条件。本文以新刑事简易程序的适用条件为视角,前两部分通过与其他国家比较以及新旧刑事简易程序之间的对照,探讨新刑事简易程序的适用范围的拓展以及适用条件的重构,重点论述新刑事简易程序适用条件在司法实践中引发关注的几个方面。其一是特殊群体法益保护,如盲、聋、哑人,或者尚未完全丧失辨认或者控制自己行为能力的精神病人以及未成年人被告人的简易程序适用条件;其二是排除重罪后的准重罪的双重否定;其三是特殊不适格情形的不完全列举。
