不动产异议登记制度作为物权法中一项重要制度,在降低因登记簿登记错误而可能给真实房产权利人造成的损害、维护不动产权利人的利益方面发挥着重要作用。这一制度写入我国物权法既顺应了我国市场经济发展的需要,也是我国民事法律制度不断完善的标志。异议登记虽然不是对错误登记的终局救济,但它可以提供及时的、临时性保护,故对于维护相关权利人有着重要意义。本文着重对不动产异议登记制度适用及启动条件等进行分析。
Real estate objection registration system, as an important system in the Property Law, plays an important role in reducing the damage that may be caused to real property owners due to registration errors and safeguarding the interests of real property owners. This system is written into China’s property law not only conforms to the needs of the development of market economy in our country, but also marks the continuous improvement of China’s civil legal system. Objection registration is not the final remedy for wrong registration, but it can provide timely and temporary protection and is therefore of great significance for the maintenance of the relevant obligee. This article focuses on the application of real estate objection registration system and start-up conditions for analysis.
