电子办公是否可以持续发展到取代传统办公,关键在于其生成的电子公文是否与纸质红头文件具有同等的行政效力。我国电子公文只在有限范围内具有行政效力,而实质上只是纸质公文的电子数据。本文通过电子公文生效要件与缺失原因分析,从制定《电子公文处理规范》以完善电子公文所需的配套行政规范、规范电子公文处理系统的软件需求两大方面提出保障电子公文行政效力的建议。
Whether the electronic office can continue to develop and replace the traditional office lies in whether the electronic documents it generates have the same administrative effect as paper-based documents. Our electronic official documents have administrative effect only to a limited extent, but they are essentially electronic data in paper documents. Based on the analysis of the factors that affect the effective entry and absence of e-documents, this paper puts forward some suggestions to ensure the administrative effectiveness of e-documents in terms of formulating the necessary administrative norms for e-document processing and standardizing the software requirements of the e-document processing system.
