在网络已快速成为音乐或其他视听著作的主要通路之际,其中所寓含的便利却导致了音乐等视听娱乐产业的业绩大幅滑落。对于未经合法许可的点对点式下载和文档交换等所引发的问题都已有相当多的文献予以探讨,然而对于愈来愈为普遍的网络广播,尤其是其中所涉及到的著作侵权和许可的问题,却鲜少论及。由于网络广播原本就寓有一定的公益色彩,并且与整个音乐和视听产业的未来发展息息相关,更涉及到电信权益与著作权的政策竞合,其中的问题错综复杂,经纬万端。目前在此领域处理得最为完整的体系,当属美国无疑。美国对于其中的权益处理在相当程度是采取了法定(强制)许可的做法,但还是引发了极大的争议,迄今还无法完全处理得当。台湾目前也面临同样或类似的问题,但却还没有配套的机制和政策来因应此发展。本文将引介美国著作权法的相关规定、因网络广播问题所引发的争论以及最近的一些重要发展,并对海峡两岸的未来政策取向提供一些具体的建议,盼能抛砖引玉,让此议题引发更多的关注和讨论。
As the Internet has quickly become the main gateway to music or other audiovisual works, the convenience it contains has led to a dramatic drop in the performance of the audiovisual entertainment industry such as music. There have been quite a few papers on the problems caused by peer-to-peer downloading and document exchange without legal permission. However, for the increasingly widespread webcasting, especially the infringement and permission of the works involved Problems, but rarely talked about. Since the original network broadcasting has a certain commonweal color and is closely related to the future development of the entire music and audiovisual industries, it also involves the policy co-operation between telecommunications rights and copyright. The problems are complicated and the latitude and longitude are. The system most thoroughly handled in this area is undoubtedly the United States. The United States has adopted a statutory (mandatory) permitting system to a considerable degree and has caused a great deal of controversy so far that it can not properly handle it properly. At present, Taiwan faces the same or similar problems, but there are no complementary mechanisms and policies to deal with this development. This article will introduce the relevant provisions of the United States Copyright Law, the controversy arising from the issue of Internet broadcasting and some recent important developments, and provide some concrete suggestions on the future policy orientation across the Taiwan Strait. We hope that this issue will lead to more Attention and discussion.
