汤稼堂指导编纂并审定的《律赋衡裁》刊刻于清乾隆 2 5年 ,是清代重要的律赋选本 ,其中汤氏撰写的“例言”8则及“余论”48则 ,尤为清代学者引录的律赋学文献 ,然因汤氏文名不显与兹书流传未广 ,有关《律赋衡裁》与汤稼堂对赋学研究的贡献 ,至今隐而未彰。考察汤氏《律赋衡裁》的理论贡献 ,要有数端 :一是律赋史观的确立 ;二是律赋“尊唐”艺术观的初成 ;三是以句法为中心的律赋批评体系的建构 ;四是书中余论部分为目前所见清代最早的赋话形式。而观其对清代律赋学的影响 ,又突出表现在两方面 ,即首开独立的律赋批评以及其“尊唐”艺术观启导清代律赋批评之重要路向。
Twenty-five years of compiling and validating the “Law, Balance and Discretion” guideline compiled by Tang Jiantang was an important litigant selection in the Qing Dynasty. Eight of the “Prefaces” written by Tang and 48 of the “Yu Theory” Especially the literature of law and literature cited by scholars of Qing dynasty, but because of the lack of famous name of Tang’s poetry and the wide spread of the book, the contribution of Tang Jia-tang’s research on Fu’s studies of “law and moral balance” has so far hidden. To study the theoretical contribution of Tang’s “law and obligation balance”, there are several aspects: first, the establishment of law conception of history; second, System construction; Fourth, part of the book is the earliest forms of Fu said so far seen in the Qing Dynasty. However, its influence on the study of law and education in Qing dynasty is also highlighted in two aspects, that is, the first legal criticism of the independent law and its “respect for the Tang” view of art led the criticism of the law in the Qing Dynasty.
