郑观应最早使用现代意义上的“宪法”概念,他和康有为等从儒家经义的普遍性理论阐释中发挥君主立宪的普遍主义,赋予宪法现代色彩。从儒家普遍主义推论现代性方案的主要问题,不在于逻辑有效性和可能性,而在于用传统学术资源嫁接现代性的目的旨归。从现代性来看,清政府内部对“宪法”一词的使用及《钦定宪法大纲》的条文规定都涉及“政体”安排这一现代宪法的实质性要素,因而,清末“宪法”已体现出强烈的现代性意味。
Zheng Guanying first used the concept of “constitution” in the modern sense. He and Kang Youwei, among others, played a universalist constitutional monarchy from the interpretation of the universalistic Confucianism, giving the constitutional modernism. The main problem of deducing the scheme of modernity from Confucian universalism lies not in the logic of validity and possibility, but in the purpose of grafting modernity with traditional academic resources. From the point of view of the modernity, the use of the term “constitution” within the Qing government and the provisions of the “Constitution of the Khynin Constitution” are all involved in the substantive elements of the “constitutional arrangement” of the modern constitution. Therefore, Constitution "has embodied strong modernity.
