基于对四川省Y县1990~2010年不同时期——国有经济艰难运行时期、产权制度剧烈变革时期和社会矛盾交织凸显时期的劳动争议热点分析,发现劳动争议热点产生和转移的主要原因有:劳动法律法规的密集颁布、劳动者自我权益意识的增强、改制企业的历史遗留问题。鉴于此,妥善处置我国劳动争议的对策选择是:探索多元运作模式,打造立体调解网络,建立劳动争议处置的矛盾化解机制;夯实基层基础工作,创新社会管理方式,建立劳动争议处置的源头管控机制;强化多方高效协作,形成整体联动格局,建立劳动争议处置的长效运行机制。
Based on the hot analysis of labor disputes during the period from 1990 to 2010 in Y County, Sichuan Province, during the difficult period of state-owned economy, the period of drastic change of property rights system and the prominent social conflicts, the main causes of the hot spots of labor dispute were: labor The intensive promulgation of laws and regulations, the enhancement of workers' self-awareness of their rights and interests, and the problems left over from the restructuring of enterprises. In view of this, the measures to properly handle the labor dispute in our country are to explore diversified modes of operation, create a network of three-dimensional mediation and establish a mechanism for resolving contradictions in labor dispute resolution, lay a solid foundation for grass-roots work, innovate social management and establish a source control mechanism for labor dispute disposition ; Strengthen multi-party and efficient collaboration, form the overall linkage pattern, and establish a long-term operation mechanism for labor dispute resolution.
