群体性劳资事件是当前突出的不稳定因素,是地方政府治理中的一大难题。对地方政府介入集体劳动纠纷行为进行分析,借助比例原则论证集体劳动关系构建中的统合与自治、实现公正劳动关系的目的与手段、行政干预的成本与收益、处置集体劳动争议的维权与维稳等关系,可以认为,通过集体谈判制度调整劳资关系是市场经济进程中的普遍规律,是对处在弱势竞争地位的劳动者权利的尽力保障,也是对雇主财产权、经营权和处置权的应有保护,能够最大程度地促进劳资两利的实现。因此,当前中国急需建立既有政府主导自上而下的立法推动,又有劳动者自下而上的行动促进的集体劳动关系治理机制。
