改革开放以来,我国教育法制建设的价值取向经历了由“效率优先”到“兼顾公平”、由“秩序第一”到“适度自由”、由“实体正义”向“程序保护”的转变,整体呈现趋于合理的态势,但是依然存在一定程度的价值取向偏失。为了完善我国教育法制建设,须在理性的、批判的、审视现实的基础上,树立正确的教育立法价值取向,实现“良法之治”。
