由于中、西方在法律文化思想的巨大差异,中国传统法律文化一定程度上阻碍了西方现代法治理念推行。本文指出“全盘西化”法治理念在当代中国不可取,必须要坚持中西合璧,取长补短,充分利用中国本土法律资源,发挥传统法律文化的积极作用,克服其消极影响,建立起符合中国国情的法律制度和中国社会主义法治。
Due to the huge differences between Chinese and Western legal and cultural thoughts, the traditional Chinese legal culture hinders to some extent the promotion of the concept of the modern Western rule of law. This article points out that the idea of “Westernization” is not desirable in contemporary China. We must adhere to the combination of Chinese and Western elements and make full use of Chinese legal resources to make full use of the positive role of traditional legal culture in overcoming its negative impact and establishing a policy that conforms to China’s national conditions Legal System and Chinese Socialist Rule of Law.
