“司法强拆”作为行政强制执行方式之一,产生对公民财产权的限制作用。其合法性基础在于:应以法律形式规定法院的司法性执行权,而非行政法规,以符合形式法治的要求;其取得,不能只有《行政诉讼法》和《行政强制法》的一般性规定,而应有财产权限制的专门立法的具体和明确的授权,以符合法律保留原则和实质法治的精神。虽然2011年《国有土地上房屋征收与补偿条例》中有关“司法强拆”的规定的合法性尚可将就,但立法机关应主动进行征收立法,否则“司法强拆”的合法性基础仍然欠缺。

Although the legality of “judicial demolitions” in the “Regulations for the Collection and Compensation of Houses on State-owned Lands” in 2011 is still acceptable, the legislature should take the initiative to impose legislation or else the legality of “judicial demolitions” The foundation is still lacking.
