我国教育法学发展30多年来,研究成果大量涌现。本文通过文献分析考察教育法学的研究方法运用与发展趋势,认为作为一门教育学与法学相交叉的学科,教育法学的研究方法呈现出以下特点:在具体研究方法的运用中,当前较成熟的研究方法有历史研究法、比较研究法、法解释研究法、案例法;在研究方法论上,从实证分析法走向价值分析法与社会分析法。同时教育法学的研究中也存在着研究方法意识欠缺的问题,但随着学科的发展成熟,研究方法越来越受到重视,需继续深入研究与拓展。
In the past 30 years since the development of educational law in our country, a large number of research results have emerged. This paper examines the application and development trend of educational law research methods through literature analysis. It considers that as a discipline of pedagogy and law, the research method of educational law shows the following characteristics: In the application of specific research methods, the current more mature The research methods include historical research method, comparative research method, law interpretation research method and case method. In research methodology, from empirical analysis method to value analysis method and social analysis method. At the same time, there is also a lack of awareness of research methods in the research of educational jurisprudence. However, with the maturity of disciplines, the research methods have drawn more and more attention and need further research and development.
