随着城市化和工业化进程的加快,大量的农村集体土地被征收为国有。然而,由于我国土地征收制度形成于计划经济时代,在现如今市场经济的环境下,存在明显缺陷。在征地补偿过程中存在着大量问题,如补偿范围狭小,补偿原则不合理和补偿比准不科学等。因此,今后的立法和实践应首先明确公平合理,可持续发展的补偿原则;提高、拓宽补偿的标准和范围,从而公平合理地解决农村土地征收补偿问题,促进社会和谐发展。 With the acceleration of urbanization and industrialization, a large amount of rural collective land is requisitioned as state-owned. However, due to the formation of land expropriation system in China in the era of planned economy, there are obvious defects in the current market economy environment. There are many problems in the process of compensation for land acquisition, such as narrow scope of compensation, unreasonable compensation principle and unscientific compensation standard. Therefore, the legislation and practice in the future should first clear the principle of fairness, reasonableness and sustainable development; raise and broaden the standards and scope of compensation so as to solve the issue of compensation for rural land acquisition fairly and reasonably, and promote the harmonious development of society.
