随着我国城市化进程日益加快,房地产市场的持续升温,房屋、土地等不动产登记已成为城市建设和发展的重要活动,科学合理的不动产权利制度能够为人们提供一个追求长期利益和稳定预期和重复博弈的规则。我国《物权法》出台作为一部规范财产关系,保护权利人权益的重要法律,但在对不动产制度登记机关的混乱、程序不统一、审查制度不健全和赔偿责任机制不完备等问题采取回避或者是模糊规定的态度,我国不动产登记制度,也面临前所未有的在立法、行政、司法领域均面临众多挑战和新的难题。
