农村居民基于集体经济组织成员的身份而享有在集体土地上修建住宅及其附属设施的权利,但只享有宅基地的占有和使用的权利,其流转受到严格的限制。实践中“小产权房”的大量出现也给宅基地的流转问题提出了严峻的考验,随着市场经济的发展,原有的宅基地的规定也不能适应新形势下市场经济的深入发展,出于对土地资源的保护,发挥物尽其用的原则,充分保障农民权益,有必要对宅基地的流转问题进行研究。
