优先购买权是民法上一项重要的法律制度,古今中外各个国家的法律对其都有一定的规定,随着经济的飞速发展,不动产优先购买权适用中的冲突被越来越多的学者加以关注。因此本文在借鉴国内外各种理论的基础上对以上问题作一些探讨,从不动产优先购买权的概述入手,分析其法律适用范围和效力,总结冲突产生的原因,并针对我国相关法律对该问题之规定的不足,从立法与实践等方面提出了一些加以完善的建议和措施,使其在保护优先购买人权益的同时能够照顾到其他当事人的合法适当利益,以便更好的有利于社会的繁荣与稳定发展。
The right of preemption is an important legal system in civil law. The law of all countries at all times and in the world stipulates the law to it. With the rapid development of economy, the conflicts in the application of real right preemption rights are more and more scholars attention.
