系统性金融危机是一种复合型的现代金融危机,有碍经济稳定增长目标的实现,这种金融市场失灵现象需要政府依法介入才能得到矫正。作为基础货币供应者的中央银行和作为财政资金管理者的政府理应合作防范和化解系统性金融危机,其各自的法定职责和实施机制构成经济法中的宏观调控法的核心内容。经济法应对系统性金融危机有层次之分:金融监管机关对金融混业经营应当善尽宏观审慎监管的法定职责,以抵御系统性金融风险的影响,避免发生系统性金融危机;系统性金融危机发生时,政府应当承担救助问题金融机构或问题资产的法定职责,以化解系统性金融危机,维护金融稳定。与此同时,政府应当牵头设立常规性的金融稳定基金和应急性的金融危机救援基金,阻断金融危机向财政危机的转化。
The systemic financial crisis is a complex modern financial crisis that hinders the realization of the goal of steady economic growth. Such failure of financial markets requires the government to intervene in order to be rectified. The central bank as the basic money supplier and the government as the fiscal fund manager should cooperate to prevent and resolve the systemic financial crisis. Their respective legal responsibilities and implementing mechanisms constitute the core of the macro-control law in the Economic Law. Economic law should be systematically divided into different levels of financial crisis: the financial regulatory authorities should exercise due diligence and macroprudential legal supervision over financial mixed operations so as to guard against the systemic financial risks and prevent a systemic financial crisis; the systemic financial crisis When this happens, the government should assume the statutory duty to rescue the financial institutions or the assets in question so as to defuse the systemic financial crisis and maintain financial stability. At the same time, the government should take the lead in setting up a regular financial stability fund and an emergency financial crisis rescue fund to stop the financial crisis from turning into a financial crisis.
