劳动不仅仅表现在它是公民的一项重要人权,而且也是作为公民个体生存与发展的主要手段而被人们所重视。现今已经逐渐得到了国际社会和各国政府的高度重视,被各国载入宪法,并成为其中的重要条款之一。纵观我国现行宪法即1982年宪法,第42条规定:“中华人民共和国公民有劳动的权利和义务。”这是基于劳动作为保障及促进公民个体和社会共同体的尊严和发展所发出的倡议。但是从该条宪法条文中我们可以明确,我国的宪法对劳动的定位,它既是一种权利,也是一种义务。
Labor is not only reflected in the fact that it is an important human right of citizens, but also taken as the main means of the survival and development of individual citizens. Nowadays, it has gradually gained the attention of the international community and governments of all countries and has been included in the constitution by all countries and has become one of the important clauses therein. Throughout our current constitution, the Constitution of 1982, Article 42 states: “Citizens of the People’s Republic of China have the rights and obligations to work.” This is based on the principle that labor as a safeguard and promotion of the dignity and development of both civic and social communities initiative. However, from this constitutional article, we can make it clear that our country’s constitutional position on labor is both a right and an obligation.
